Madeleine: Court of Appeals nullifies ban on the sale of a book of Goncalo Amaral Lisbon, Oct 19 (Lusa)

-- A Court of Appeal overturned the ban on the sale of the book of Goncalo Amaral "Maddie -- The Truth of the Lie", which had been decided by the Civil Court of Lisbon in the wake of an injunction brought by the parents of Madeleine McCann.

Judicial Source said today the Lusa agency that the appeal presented by ex-inspector of Police Goncalo Amaral "was upheld", by which the book and the video with the same title, based on a documentary aired in TVI, may again be marketed.

Goncalo Amaral, who argues in the book thesis of involvement of Kate and Gerry McCann in the disappearance of her daughter in May 2007, in a tourist apartment in Algarve, you can still give interviews, either in Portugal or abroad.

O Tribunal da Relação anulou a proibição de venda do livro de Gonçalo Amaral "Maddie -- A Verdade da Mentira", que tinha sido decidida pelo Tribunal Cível de Lisboa na sequência de uma providência cautelar interposta pelos pais de Madeleine McCann. Fonte judicial disse hoje à agência Lusa que o recurso apresentado pelo ex-inspetor da Polícia Judiciária Gonçalo Amaral "foi julgado procedente", pelo que o livro e o vídeo com o mesmo título, baseado num documentário exibido na TVI, podem voltar a ser comercializados. Gonçalo Amaral, que defende no livro a tese de envolvimento de Kate e Gerry McCann no desaparecimento da filha em maio de 2007, num apartamento turístico do Algarve, pode ainda conceder entrevistas, quer em Portugal quer no estrangeiro. A mesma fonte precisou que o recurso do ex-inspetor da PJ, apresentado pelo advogado António Cabrita, foi "o único" a ser analisado pelo Tribunal da Relação de Lisboa, que entendeu não considerar os apelos da Guerra & Paz, editora do livro, da TVI e da Valentim de Carvalho, que comercializou o vídeo. O julgamento da providência cautelar, decretada provisoriamente a 09 de setembro de 2009, realizou-se em quatro sessões, em meados de janeiro. Na ação principal, a família McCann reclamava a proteção dos direitos, liberdades e garantias. Além deste processo, Kate e Gerry McCann interpuseram contra Gonçalo Amaral uma ação por difamação, em que é pedida uma indemnização de 1,2 milhões de euros, e uma outra por violação do segredo de justiça. Madeleine McCann dsapareceu em 03 de maio de 2007, num apartamento de um aldeamento turístico da Praia da Luz, Lagos, onde se encontrava de férias com os pais e os dois irmãos. Na qualidade de coordenador do Departamento de Investigação Criminal da PJ de Portimão, Gonçalo Amaral integrou a equipa de investigadores que tentou apurar o que aconteceu à menina inglesa. Kate e Gerry McCann, que sempre mantiveram a posição de que Madeleine foi raptada, foram constituídos arguidos em setembro de 2007, mas acabaram por ser ilibados em julho de 2008 por falta de provas para sustentar a hipótese avançada pelo inquérito de morte acidental da menina. O Ministério Público arquivou assim o processo, que poderá ser reaberto se surgirem novos dados considerados consistentes sobre o desaparecimento da criança. Lusa/Fim.
