The former Inspector of Judicial Police (PJ) Goncalo Amaral today said that the decision of the Court of Appeal to annul the prohibition of sale of the book "Maddie - The Truth Lies" means " strengthening of Portuguese democracy. " Gonçalo Amaral is pleased that "ultimately there is democracy," and confessed to the agency Lusa that he hoped the judges of Appeal reversed the decision of Lisbon Civil Court to prohibit the sale of the book after an injunction filed by the parents of Madeleine McCann. Lisboa, 19 out (Lusa) -- O ex-inspetor da Polícia Judiciária (PJ) Gonçalo Amaral considerou hoje que a decisão do Tribunal da Relação em anular a proibição de venda do livro "Maddie -- A Verdade da Mentira" significa "o reforço da democracia portuguesa".
Gonçalo Amaral regozijou-se por "afinal existir democracia" e confessou à agência Lusa que esperava que os juízes da Relação revogassem a decisão do Tribunal Cível de Lisboa de proibir a venda do livro após providência cautelar interposta pelos pais de Madeleine McCann.
"O livro é um exercício de cidadania e de liberdade de expressão. Com esta decisão da Relação, foi a democracia portuguesa que ganhou, pois a proibição de venda do livro era inconstitucional", disse Gonçalo Amaral à Lusa.
O ex-inspetor da PJ classificou ainda de "muito importante" a decisão da Relação para os dois processos interpostos pelos pais da menina inglesa desaparecida em 2007, no Algarve, ainda sem data marcada para início do julgamento.
No processo cível, Kate e Gerry McCann reclamam 1,2 milhões de euros por difamação, enquanto no outro caso Gonçalo Amaral é acusado de violação do segredo de justiça.
A decisão de anular a proibição de venda do livro "Maddie -- A Verdade da Mentira" e o vídeo com o mesmo título, baseado num documentário exibido na TVI, foi hoje comunicada à agência Lusa por fonte judicial.
Com a decisão, o livro e o vídeo podem voltar a ser comecializados e Gonçalo Amaral, que defende no livro a tese de envolvimento de Kate e Gerry McCann no desaparecimento da filha em maio de 2007, num apartamento turístico do Algarve, pode voltar a falar publicamente no caso.
A decisão de proibição da venda do livro e do vídeo tinha sido decretada em 14 de janeiro pela juíza Cunha Rodrigues, da 7.ª Vara do Tribunal Cível de Lisboa, que julgou a providência cautelar interposta pelo casal McCann.
A proibição fora decretada provisoriamente a 09 de setembro de 2009 e, na ação principal, a família McCann reclamava a proteção dos direitos, liberdades e garantias.
Madeleine McCann desapareceu em 03 de maio de 2007, num apartamento de um aldeamento turístico da Praia da Luz, onde se encontrava de férias com os pais e os dois irmãos.
Na qualidade de coordenador do Departamento de Investigação Criminal da PJ de Portimão, Gonçalo Amaral integrou a equipa de investigadores que tentou apurar o que aconteceu à menina inglesa.
Kate e Gerry McCann, que sempre mantiveram a posição de que Madeleine foi raptada, foram constituídos arguidos em setembro de 2007, mas acabaram por ser ilibados em julho de 2008 por falta de provas para sustentar a hipótese avançada pelo inquérito de morte acidental da menina.
O Ministério Público arquivou o processo, que poderá ser reaberto se surgirem novos dados considerados consistentes sobre o desaparecimento da criança.
