£1m McCann court battle

12 December 2011
Scottish Daily Record
Tom Worden

GERRY and Kate McCann's £1million lawsuit against the cop who bungled the hunt for Madeleine will be heard in two months.

The civil case against Goncalo Amaral will take place in Lisbon on February 9 and 10, a source close to the couple said yesterday.

Amaral, 52, ran the investigation into the three-year-old's disappearance in the Algarve resort of Praia da Luz in 2007 for five months before being removed.

He later made a fortune selling a book and TV documentary claiming the youngster was dead and wrongly accusing her parents of staging a cover-up. The McCanns lodged a 36-page writ in the Portuguese capital in June 2009 accusing him of libel and breaching their human rights.

The source said: "Amaral has made the McCann family's life hell and himself rich in the process.

"Kate and Gerry want to stop him spouting malicious lies about them and profiting from their pain.

"The only way to do that is by going to court."

In their writ, the McCanns describe the now-retired detective as a self-obsessed, manipulative money-grabber with no morals.

The commissioner accused parents

With its impressive stature and his bald head, he is the absolute nightmare of spouses McCann. Former commissioner of the Portuguese Judicial Police of Portimão, Goncalo Amaral directed the investigation on the disappearance of Maddie for several months. A professional failure, but also a good source of trouble : disowned by his hierarchy after having publicly criticized the attitude of the English police, he was prematurely departs from the investigations. The investigator is in spite of everything sure to hold the truth. After resigning from the police to regain his freedom to speak, he delivered his version in a book for the prosecution against the parents of the little girl, published in England in 2008.

The thesis of Goncalo Amaral is clear : Maddie is dead accidentally by the negligence of the parents who would have then done disappear its corpse and put in scene the thesis of the abduction. The book offers no evidence, but rather a series of indices, to begin with what he called the "Contradictions in the statements of the spouses McCann". The policeman also insists on the traces of blood found in the apartment. "Unfortunately, it is a corpse that he must seek", assigned to us-it in May 2009 , when the output of the book in France * .

Kate and Gerry McCann have continued to fight to prohibit the dissemination of this book. After having won the case, they were dismissed on appeal by a court of appeal Portuguese, in the name of freedom of expression. In 2010, the former policeman has published a second book, non-translated in France and entitled "The English Gag " (le gag anglais). This time, it puts in question the English authorities to have weighed on the investigation. When we had met in Paris, he was already part of its criticism of the general staff of the British police : " n Great Britain, the vision of the folder is political ," he complained.

Too many ‘if onlys’
08 July 2011
The Witness

Madeleine is the disquieting account of the disappearance and subsequent search for the British girl Madeleine McCann, written by her mother Kate, and includes excerpts of the diary Kate kept over that harrowing period.

It’s a riveting personal account of the incident, which many of us have read much about in the years since Madeleine was snatched, but at the same time, the enormity and horror of what happened to the gorgeous three-year-old, and what might have happened to her subsequently, make it a harrowing read. Madeleine’s happy wide-eyed photo on the cover is heart-wrenching.

Mixed Teams will not solve crime in the Algarve

Goncalo Amaral says that there is not a strategy to combat insecurity, but it only answers to one-off events. Accuses institutions of inertia and do not react to accusations false abroad

INTERVIEW

Oantigo coordinator of the Department of Portimao the Judicial Police says that the insecurity in the Algarve because of the violent crime resulting from the lack of strategy of the security forces and the agents of tourism. Goncalo Amaral, 51 years old, known to have investigated the disappearance of Maddie, rejects the solution decided in this month of creating mixed teams with agents of several policemen and accuses the authorities of not reacting to complaints alarmist, for example in England.

IT needs a "special team", the likeness of created by the Attorney-general 'S Office for violence on the night of the Port, in order to fight the violent crimes in the Algarve and reassure the tourists?

I understand the question. But, contrary to what some claim, the Algarve does not need a special plan of security, much less for special teams - which only serve to increase the wages of their components - not even more human and material resources to combat the criminal phenomenon that, in truth, has gained prominence. What we need is to define a strategic plan that involves promoters and tour operators, mayors, security forces and services.

But this takes time and the holidays are there…

We must react to every crime, with a rapid and effective response, but it is impossible not to detect, to study the phenomenon, preventing it and forming criminal investigators capable of acting together - something that is not made. It is true that the conviction of security has suffered earthquakes and much by force of inertia of the institutions, not to promote and preserve the Algarve as a safe destination. AND also of the forces and security services to the act only reactivamente, the flavor of punctual event criminal.

Lisbon, June 18 (AFP) - The Évora refuted the existence of "unconstitutionality and nullity" in ruling that upheld the conviction of former inspectors of the Judicial Police (PJ) in the process of aggressions against Leonor Cipriano, Joana's mother, child missing in the Algarve in 2004.

On 18 March this year, the Court of Appeal upheld the conviction of former PJ inspector Gonçalo Amaral and António Nunes Cardoso, with suspended sentences, the Court of Faro in 2009, but the latter required the former agent "to reform and clarification of Judgement. "

According to judicial sources, the Évora understood that "lacks reason" the application of Antonio Nunes Cardoso, sentenced to two years and three months imprisonment with suspended sentence for the crime of forgery of a document.

Why Kate? From the moment that their daughter vanished from a rented holiday apartment in Portugal's Praia da Luz resort, it was Gerry McCann who provided the public face of the campaign to bring Madeleine home. He was the one who dealt with reporters, set up websites, wrote a regular blog updating the search. If anyone was going to write a book about that time, it was surely Gerry who would've been expected to do it.

COMMENTS

It is the spiritual sanctuary to which Kate and Gerry McCann return time and time again with each passing year. Usually their visits are in private, occasionally with close relatives. But it is here, in the tiny, white-washed 17th-century church of Our Lady of Light, overlooking the sea in Praia da Luz on the Algarve, where the couple feel closest to Madeleine, their cherished oldest child, who next month will have been missing for four years. Here is where Kate, especially, in the words of parish priest Father Haynes Hubbard, her Portuguese pastor and confidant, "comes back to cling to the hope that their daughter will come home".

Supreme Court turns down McCanns' request

Supreme Court turns down McCanns' request (English translation courtesy of "Astro")
18 March 2011
Sol (Portuguese original article)
Margarida Davim

Kate and Gerry McCann wanted the Supreme Court of Justice to nullify a decision by the Appeals Court that allowed for the book by Gonçalo Amaral, ‘The Truth of the Lie’, to be distributed. Nonetheless, the judges have refused the request.

Former Polícia Judiciária inspector Gonçalo Amaral will again be able to sell the book about the disappearance of Madeleine McCann, ‘The Truth of the Lie’, which was taken off shelves after an injunction that was filed by the parents of the little English girl that disappeared in Praia da Luz was accepted by a lower court.

The Supreme Court judges refused the request for an “exceptional review” of the Appeals Court’s decision, which overturned the injunction that had been filed by Kate and Gerry McCann.

The counsellors’ decision may be appealed to the Constitutional Court, but that will have no suspensive effect, which means that Kate and Gerry McCann will have to return every copy of Amaral’s book that they possess.

If they do not comply, they may even incur in a crime of disobedience.

Contacted by Sol, the McCanns’ lawyer, Isabel Duarte, refused to comment on this judicial decision, because she hadn’t been notified yet.

Twitter users libeling Goncalo Amaral

Twitter is an interesting social networking site.  The McCann case has been discussed by many "tweeters"; the topic found by the hash-tag "#McCann" or "#McCanns".

There are a number of people who are apparently determined to prevent Twitter participants from discussing the case in a factual manner, and whose motives and integrity are questionable (to say the least).

Goncalo Amaral is frequently their target and they are clearly part of the effort to discredit him.

Here are examples of the type of  lies/libel they are tweeting.  Note "pinkypoo666"'s tweet stating:

"This is what Amaral does to ppl when he questions them" http://aeiou.expresso.pt/online/Storage/ng1011060.jpg"

When confronted with the FACT that Cipriano never accused Amaral of the ALLEGED "assault", "pinkypoo666" tweeted this:

"this is what Amaral & PJ do 2 people who dont confess, even if innocent.  He likes 2 tie things up quickly so can go to pub"

Although little is being currently published in the mainstream press regarding Goncalo Amaral, it is obvious that "behind the scenes" there are ongoing efforts to discredit him and others who do not subscribe to the "abduction" theory in the McCann case.

Blogs and websites have been created to attack Dr. Amaral and the PJ, attempts are being made to start rumors, statements are taken out of context or deliberately misquoted and lies (including the ones above) are rampant.

The path to truth is a straight and narrow course.  It certain appears that many people involved in the defense of the McCanns do not choose to walk it.

(NOTE: The post date on this has been changed.  It does not deserve to remain as the first post on a blog entitled "Truth be Told".  The date has been edited from when it was posted (8 March 2011) as changing the post date is the only way I'm aware of to rearrange the order posts appear on Blogger.)

Minha Dignidade

I'm working on a project that is requiring me to re-read hundreds of articles published about "The Truth of the Lie", Goncalo Amaral, and the investigation into the disappearance of Madeleine McCann.

In light of the recent wikileaks cable related to the McCann case, I am wondering whether there will be any apologies issued by the British Press - or by specific reporters who have amplified the McCann's attacks on Dr. Amaral.

It is now public knowledge that Goncalo Amaral was NOT solely responsible for suspicions of parental involvement in the death and concealment of Madeleine McCann's body.  Read the cable for yourself  HERE (or elsewhere on the net - it can be found many places including the various wikileaks mirrors - search 07LISBON2527).

To this day, the McCann attacks focus on Goncalo Amaral, rather than on the British police (who, along with their Portuguese colleagues developed evidence against the McCanns).  They have caused the Amaral family great hardship, they have attempted to completely destroy his reputation - on what grounds?

The Truth of the Lie does not waver from the official investigation and its conclusions were not only the conclusions of the writer.

It is long past time that the British Press takes its "code of conduct" policies seriously.  Report the facts and correct all errors in previous reports. A good place to start would be to correct the articles claiming the McCanns were "cleared" and that Goncalo Amaral was a "disgraced cop".  The McCanns were not cleared - their arguido status was lifted and the case SHELVED until new evidence comes to light.  And Dr. Amaral has not been the sole source of the allegations against the McCanns.

There should be no tolerance for what the media has done in this case.  From the Press Association to the BBC to the smallest regional newspaper, the Press has entirely destroyed its credibility.

Here is an interesting example of an article that looks quite different when read in light of the wikileaks cable:

A copper without shame

...

And here is a site where you don't need to wade through that particular reporter's spin regarding what Goncalo Amaral wrote. Read the book yourself and do not allow people like Richard Pendlebury of the Daily Mail to determine your reaction.  (As my wise father taught me and as I have taught my children: Never, ever, ever allow yourself to be lead by the nose by the Media;  not in the case of Dr. Amaral and not in regard to any other issue.)
